General Terms and Conditions
1. Scope
The General Terms and Conditions regulate the legal relationship between the guest and Berghaus Bargis. They apply to reservations for overnight stays, meals, and other services.
2. Conclusion of Contract
A contract is concluded exclusively by e-mail, is binding for both parties, and is only valid with our electronic confirmation.
3. Deposits
The overnight costs (or, for groups, the reservation fee) are due 7 days after receipt of the confirmation (invoice).
4. Cancellations
Short-term cancellations (from 24 hours before planned arrival) must be communicated by telephone (to the staff on site).
Accommodation cancellation fees:
Cancellation up to 14 days before arrival: free of charge
Cancellation 13 to 7 days before arrival: 50% of the reserved services
Cancellation 6 to 0 days before arrival: 100% of the reserved services
Refunds of amounts already paid within the permitted cancellation period will be issued either as a credit (your balance will be recorded with us) or as a reimbursement of your prepayment.
On New Year’s Eve, gourmet evenings, or for ordered gourmet menus, the cancellation fee is CHF 100 per person if we cannot reallocate the table. For bookings between December 20 and January 6 that are canceled after November 30, there is no entitlement to a refund of the prepaid amount, regardless of the above rules.
Cancellation due to force majeure: In cases of force majeure (storms, avalanche danger, landslides, etc.), Berghaus Bargis may cancel reservations at short notice for safety reasons. In such cases, the guest will receive the prepaid amount as a credit.
5. Dogs
We also have rooms where dogs are welcome. Please inform us at the time of reservation if you are bringing a dog so we can reserve the appropriate room. Dogs are allowed in the restaurant area but must be kept on a leash.
6. Prices
Prices quoted by Berghaus Bargis are always in Swiss Francs (CHF), exclusive of tourist taxes but inclusive of statutory VAT. Overnight rates are per person.
7. Tourist Taxes / Guest Card
Guests are obliged to pay the applicable tourist taxes.
8. Price Changes
Berghaus Bargis may change published prices in the following cases:
newly introduced or increased government levies (e.g., VAT, tourist taxes, etc.)
obvious printing errors
extraordinary price increases
Price changes affecting our offer are introduced at the beginning of the calendar year. For bookings made earlier (at the prices valid at the time of booking), the prices of the stay date apply. Price changes for food and beverages are binding from the printing date of the new menu.
9. Payment
Invoices are issued in Swiss Francs (CHF). The following cards are accepted: Maestro (EC Direct), MasterCard, Visa, and the new Post Card. Payment via TWINT is also possible.
10. Vouchers
Vouchers issued by Berghaus Bargis are denominated in Swiss Francs (CHF) and can be redeemed for goods and services at the Berghaus. Remaining balances will be credited. Cash payouts are not possible. For vouchers with a non-monetary value older than one year (e.g., overnight stay in a double room, gourmet menu, etc. without price indication), current Bargis prices apply. Any difference must be settled on site.
11. Liability and Damages
Berghaus Bargis accepts no liability for damage to or loss of personal property. Guests are liable to Berghaus Bargis for damages or losses caused by them. Damages caused by guests (to furniture or other property of Bargis) will be charged to the guest.
12. Parents’ Liability
Parents are liable for their children, particularly regarding the playground and use of play equipment.
13. Road Maintenance
The maintenance of the road to Bargis is the responsibility of the municipality of Flims.
14. Transport
Transport is subject to the regulations of Berghaus Bargis. Berghaus Bargis is not obliged to provide transport.
17. Validity
The house rules of Berghaus Bargis must be observed.
18. Applicable Law / Jurisdiction
Swiss law applies exclusively to reservation agreements, general conditions, and additional agreements.
Additional Cancellation Policies and Goodwill Arrangements
Since we do not wish to upset or lose our guests, we strive to find fair solutions for all parties in the event of a cancellation. Our goodwill policy is as follows:
If a guest cannot attend, we credit the already paid overnight fee for a one-time postponement of the stay within one year. (Rebooking fee per room CHF 10). The credited overnight fee can be used for one or more overnight stays (depending on the original booking) between Sunday and Thursday (same number of persons, same number of nights in a row, same room category, if available). A second or further postponement is generally not possible. Postponed reservations (where the payment is credited) are only possible from Sunday to Thursday and not during peak holiday periods (July to mid-August, early to mid-October, and Christmas until January 6).
Weather-related cancellations: Guests who cancel due to unsuitable weather may also reschedule within one year, but only on short notice, at the earliest 3 days before the planned visit, to allow realistic weather assessment. For Fridays, Saturdays, and peak holiday periods, short-term requests (24 hours before arrival) are possible. If rooms are available, we will gladly rent them. Bargis vouchers and credits are treated like cash and accepted as deposits.
If a guest does not appear as agreed or according to their reservation, the voucher/credit will be charged as a deposit and forfeited. In the pre- or off-season, there may be days when we have no overnight bookings. On such days, Berghaus Bargis may close in the evening.
Medical certificate: If you cannot attend your stay at Berghaus Bargis for health reasons, a medical certificate serves to claim reimbursement of overnight costs from your cancellation insurance.
Cancellations due to bad weather: We are not a traditional mountain hut but a small mountain house. Short-term weather-related cancellations are not possible. Since we offer a wide selection of freshly prepared dishes (ingredients ordered several days in advance), cancellations due to bad weather inevitably lead to food waste, which we strictly avoid. Please help us prevent food waste by not canceling at short notice. For hikers who only wish to come in good weather, we recommend booking rooms at short notice when the weather forecast is favorable.
